1. Agreement to Terms

Welcome to Forbes Pakistan. These Terms of Service ("Terms") govern your access to and use of all Forbes Pakistan websites including forbes.com.pk, mobile applications, and other online products and services (collectively, the "Services") provided by Forbes Pakistan ("Forbes Pakistan," "we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

We may modify these Terms at any time. If we make changes, we will provide notice by revising the date at the top of these Terms. Your continued use of the Services after any modification constitutes your acceptance of the new Terms.

2. Use of Services

• Use the Services in any manner that could disable, overburden, damage, or impair the Services
• Use any robot, spider, scraper, or other automated means to access the Services

3. User Accounts

Some features of our Services require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. We reserve the right to suspend or terminate your account if any information proves to be inaccurate, not current, or incomplete.

You must notify us immediately of any unauthorized use of your account or any other breach of security at support@abc.com.

4. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Forbes Pakistan, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The Forbes Pakistan name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Forbes Pakistan or its affiliates or licensors. You must not use such marks without the prior written permission of Forbes Pakistan.

All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

5. User Content

Our Services may allow you to post, submit, publish, display, or transmit content, including comments, reviews, and other materials ("User Content"). You retain ownership of your User Content, but by posting it, you grant Forbes Pakistan a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content.

You represent and warrant that you own or control all rights to your User Content and that your User Content does not violate these Terms or the rights of any third party.

We reserve the right to remove or modify User Content for any reason, including content that we believe violates these Terms or may be offensive, illegal, or violate the rights of any person.

6. Subscriptions and Payments

Some Services may be available only through paid subscriptions. Subscription fees are charged in advance on a recurring basis (monthly or annually, depending on your plan).

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings or by contacting customer support.

We reserve the right to change subscription prices. Any price changes will be communicated to you in advance and will apply to your next billing cycle.

Refunds are generally not provided for partial subscription periods, except as required by applicable law or at our sole discretion.

7. Third-Party Links and Services

The Services may contain links to third-party websites, services, or content that are not owned or controlled by Forbes Pakistan. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Your interactions with third-party services are solely between you and the third party. We encourage you to read the terms and privacy policies of any third-party services you access.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Forbes Pakistan does not warrant that the Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Services are free of viruses or other harmful components.

Any content downloaded or otherwise obtained through the use of the Services is accessed at your own risk, and you will be solely responsible for any damage to your computer system or mobile device or loss of data that results from such download.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORBES PAKISTAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL FORBES PAKISTAN'S TOTAL LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID FORBES PAKISTAN, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Forbes Pakistan, its affiliates, and their respective officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in New York, New York.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
